Effective upon the execution of a Purchase Form involving the purchase of iLobby’s EmergencyOS products or services (“EOS”), (the “EOS Effective Date”), you or the organization you represent (“Customer”) agree with iLobby that you have read, understood and accept all the additional provisions of this EmergencyOS Terms & Conditions Schedule (the “EOS Schedule”) and agree to be legally bound by them in addition to those of the Subscription Agreement or any End User License Agreement or Subscription Agreement previously agreed by both iLobby and Customer.
The EOS is provided "as is" without any representations or warranties, express or implied. The software is not intended to be a substitute for common sense and is not a guarantee of safety. Notwithstanding anything to the contrary in the Subscription Agreement, iLobby is not liable for any damages, whether direct, indirect, incidental, or consequential, arising from the use or inability to use the EOS or from any reliance on the information provided by the EOS.
The EOS provides general guidance and information about building evacuation, which may not be applicable in all situations. It is the responsibility of the Customer, and the building occupants to assess their individual circumstances and take appropriate action to ensure their own safety. iLobby does not assume any liability for any actions taken or not taken by the Customer and/or the building occupants based on the information provided by the EOS.
The EOS is not a replacement for emergency response procedures and the Customer and/or the building occupants should always follow the instructions provided by emergency responders during an emergency situation. iLobby does not assume any liability for any actions taken or not taken by the Customer and/or the building occupants or emergency responders based on the information provided by the EOS.
By using the EOS, Customer acknowledges and agrees to the terms of this disclaimer. If Customer does not agree to these terms, you should not use the software.
